Emerging Issues

Child Support Modification in present economy.

Many people are being laid off from their jobs in this difficult economy and finding it difficult to meet their obligations, especially their child support obligations. Now is the time to consider reducing your child support obligation to ease your economic burden and make ends meet.

If you don’t modify your child support obligation you will be liable for any back child support you did not pay. It, therefore, makes sense not to accumulate this debt and to petition the Court to reduce your child support obligation and work out a payment plan for any unpaid child support.

New child support guidelines became effective January 1, 2007. The most significant change to the law was the creation of the exception to the two (2) year rule. Prior to this new law, a person owing child support could not modify his child support obligation until two years after the date of the order. Now if you suffer an involuntary reduction or loss of income you do not have to wait two years to request a modification.

The cost of retaining an attorney would be worth the savings gained by reducing your child support obligation and preventing the accumulation of a potentially insurmountable debt in child support arrears.
